More than two years after the eviction of Wijde Heisteeg 7 in the city centre of Amsterdam, two people are still fighting against a prison sentence for squatting a house that it is still empty to this day.

The eviction took place on 23 December 2016 some hours after the civil court case was lost. At the eviction 4 people were arrested and they were charged with squatting. In November 2017 all four were convicted by the district court of Amsterdam. Two of the people were ordered to pay a fine of 500€. The other two people were ordered to prison sentences of four and six weeks. After the court case they were ordered by the Prosecutor to submit DNA samples to the national database.

The son of the owner filed a claim for € 106.110,60 in damages and also requested compensation for lost rent and VAT. The court declared this request inadmissible.

The people who risk prison sentences have appealed the verdict and there is no date for the hearing yet. But we know that the son of the owner upholds his request for compensation in the appeal procedure for a house that is still empty to this day, except for the ground floor, which since the eviction has been rented out to a small clothing 'antikraak' pop up store.

Ruim twee jaar na de ontruiming van Wijde Heisteeg 7 in Amsterdam centrum, vechten twee mensen nog steeds tegen een gevangenisstraf voor het kraken van een huis dat vandaag de dag nog steeds leeg staat.

De uitzetting vond plaats op 23 december 2016, enkele uren nadat de civiele rechtszaak verloren was gegaan. Bij de uitzetting werden 4 mensen gearresteerd en aangeklaagd wegens kraken. In november 2017 kregen twee van de gearresteerden een boete van 500€ en werd hen gevraagd om hun DNA-monsters te geven. Voor de andere twee personen heeft de rechtbank gevangenisstraffen, een van vier en een van zes weken en DNA-monsters van elk van hen bevolen.

De zoon van de eigenaar diende een vordering in voor € 106.110,60 aan schadevergoeding en compensatie voor het verlies van huur en BTW. de rechtbank verklaarde dit verzoek onontvankelijk.

De mensen die het risico van gevangenisstraffen lopen, zijn in beroep gegaan en er is nog geen datum voor de hoorzitting. Maar we weten dat de zoon van de eigenaar zijn verzoek om schadevergoeding in de beroepsprocedure voor een huis dat vandaag de dag nog steeds leeg staat, met uitzondering van de begane grond, die sinds de uitzetting is verhuurd aan een kleine antikraak-kledingwinkel.
