Dat kan natuurlijk niet. Daarom eisen wij met haar: uitbetaling van het loon waar ze recht op heeft, duidelijkheid over de commissies en correcte uitbetaling daarvan, en respect voor alle medewerkers van Stromma.

In april 2018 ging startte Daria, met een 0-urencontract, als locatiebeheerder bij rondvaartbedrijf Stromma. Dat houdt kort gezegd in dat je de kaartverkoop voor de rondvaart doet en het winkeltje bijhoudt van waaruit dat gebeurt. Het is werk voor minimumloon en, terwijl Daria herhaaldelijk te horen kreeg dat ze (erg) goed haar werk deed, ze heeft al die tijd nauwelijks opslag gekregen. Toen ze dat ter sprake bracht bij een teamleider, kreeg ze op intimiderend te horen dat ze blij moest zijn dat ze werk had als buitenlander.

Respectloze leiding & onduidelijke commissie

Het tekent de houding van een tweetal leidinggevenden. Zo kreeg Daria te horen dat ze wel een “triest leven” moest hebben, toen ze eens met collega’s nog wat ging doen na werktijd. Ook werd ze “control freak” genoemd omdat ze dingen graag netjes hield. En dat terwijl het gerucht gaat dat sommige managers de medewerkers in de gaten houden met camera’s. Ook worden er ongepaste opmerkingen gemaakt naar werkende moeders. Zo werd één gevraagd of haar huidige vriend de vader van haar kind is, en een ander of haar kind gepland was. Andere vrouwen kregen te horen dat ze er om acht uur ‘s ochtends nogal slaperig uitzagen, en dat als ze nou om zes uur zouden op staan ze er frisser uit zouden zien. Het hogere management heeft nooit ingegrepen om het respectloze gedrag een halt toe te roepen, of is daar simpelweg niet van op de hoogte.

Stromma werkt met een commissie systeem. Daarbij was het zo dat je gewoon meer betaald kreeg als je meer verkocht. Recent heeft Stromma dat omgegooid. Nu krijg je dat extraatje bovenop je minimumloon alleen maar als de specifieke winkel waar je werkt haar target haalt. Maar als lokaciebeheerder werk je vaak in verschillende winkels, dus duidelijker wordt het er niet op. Helemaal niet als het systeem daarnaast ook niet goed wordt bijgehouden. Zo blijken niet alle dagen geregistreerd te worden, en laatst ontbrak zelfs een hele winkel in het overzicht.

Inbreuk op de privacy leidt tot onzin-ontslag

De locatiebeheerders hebben onderling een ‘google group’. Daarmee wisselen ze onder andere diensten, en houden ze elkaar op de hoogte als er weer eens niet klopt met de loonstroken. Nadat Daria haar leidinggevenden had laten weten dat februari haar laatste maand zou zijn, stuurde ze ook een bericht over deze google group naar haar collega’s. Daarin liet ze weten met de meeste mensen goed samen te hebben gewerkt, maar ook dat sommigen haar meer werk bezorgden doordat ze de kantjes er af liepen. Daarbij noemde ze niemand bij naam.

De eerder zo respectloze teamleider greep dit als excuus aan om haar meteen van het rooster te halen. De mail zou niet volgens de ‘waarden van het bedrijf’ zijn geweest, en dit zou het rechtvaardigen dat Daria niet meer in februari mocht werken. Nou hebben we de mail gezien, en we hebben niets gezien dat dit rechtvaardigt. Daarnaast was het bericht niet openbaar, en ook niet eens verstuurd via de communicatiekanalen van Stromma. Diezelfde leidinggevende heeft zich bovendien met zijn nare gedrag zich niet eens gedragen naar algemeen geldende fatsoensnormen. Tenslotte, hoe komt de teamleider aan het bericht dat Daria heeft verstuurd? Mogelijk camera-toezicht is blijkbaar niet de enige inbreuk op de privacy bij Stromma. Maar wat ze verder ook waar precies geschreven heeft: Geen enkele wet- of regelgeving rechtvaardigt dit ontslag op staande voet. Kortom: dit is weer eens een onzin-ontslag.

Een doorzichte truc

Als klap op de vuurpijl probeert Stromma zich nu achter nieuwe wetgeving te verschuilen, die juist bedoeld is om flexwerkers meer rechten te geven. Sinds begin dit jaar kan je namelijk als werker met een 0-urencontract je contract opzeggen met een termijn van 4 dagen. Maar Daria heeft zowel mondeling als schriftelijk duidelijk aangegeven dat ze in februari nog zou werken. Toch probeert Stromma nu te doen alsof ze haar na 4 dagen van het rooster voor februari (waarin ze volledig ingeroosterd stond) kunnen halen. Het is een doorzichtige truc, en we laten ons niet om de tuin leiden.

Daria was al (veel) langer dan 3 maanden aan het werk bij Stromma, dus heeft ze het recht om ingeroosterd te worden volgens het gemiddelde aantal uren dat ze in de voorgaande maanden heeft gewerkt. Of, als dat dan niet gebeurt, dan heeft ze recht op het geld dat ze had verdiend als ze wel was ingeroosterd. Omdat Daria gemiddeld vijf en een halve dag per week werkte, komt dit zelfs met minimumloon nog uit op een flinke som: meer dan 2000,- euro. En dan hebben we het nog niet over de commissies die zij en collega’s hebben gemist, omdat Stromma om onduidelijke redenen de toekenning zeer ondoorzichtig heeft gemaakt en slecht bijhoudt.

Onze eisen

We eisen met Daria:

– Uitbetaling van het aan Daria verschuldigde loon over februari.
– Duidelijkheid over, en correcte uitbetaling van de commissie aan Daria en haar collega’s.
– Respect voor de medewerkers van Stromma.

Als deze eisen niet worden ingewilligd, zijn we genoodzaakt actie te ondernemen.

Daria worked for Stromma for almost 2 years. And she did a good job, despite disrespectful behavior of managers and errors in the commission system. But when she indicated a month in advance that she would leave and start another job at the beginning of March, she got a nasty surprise. She was taken off the schedule for february and therefore missed out on more than 2000 euros of wages! That, of course, is both illegal as well as unacceptable. That is why together with her we demand: payment of the wages to which she is entitled, clarity about commission earned and correct payment thereof, and respect for all Stromma employees.

In April 2018, Daria started as location manager at Stromma with a zero hour contract. In short, that means that you sell tickets for boat tours and look after the shop from which they are sold. It is minimum wage work, and she has rarely received wage increases in this time. Even though during that time Daria was told repeatedly that she did her job (very) well. When she brought this up with a team leader, she was intimidated to hear that she should be happy that she had a job. Reference was made to her foreign background.

Disrespectful management & unclear commission

Disrespectful management marks the attitude of two of the managers. For example, Daria was told that she must have had a “sad life” when she stayed at work a little longer because she was going to do something with colleagues after work. She was also called a control freak because she liked to keep everything tidy. In addition, inappropriate comments were made to working mothers. One, for instance, was asked if her current boyfriend was the father of her child. Another, if her child was planned or not. Other women were told at the start of a shift that they looked rather sleepy (at 8 am!), and that if they would just get up at 6 they would look fresh at the start of the working day. Finally, some managers are rumoured to keep an eye on employees with cameras. Senior management either does not know or simply does not act on this.

In addition, the commission system was recently changed. It used to be that you got paid more if you sold more, now you only get commission if the specific store where you worked achieved its target. As a shop assistant you often work in different stores, so it doesn’t get any easier. Not at all if the system also makes errors on top of this. Not all days worked appear as registered on the system, and recently an entire store’s commission was missing.

Breach of privacy leads to nonsense dismissal

The location managers have a “google group” among themselves. With this, among other things they exchange shifts and keep each other informed if the wage slips are not right again. When Daria informed her managers that February would be her last month, she also sent a message about this in the google group to her colleagues. In it she stated that she had worked well with most people, but also that some of them made her have to work more because they were slacking off. She mentioned no one by name.

The previously disrespectful team leader took this as an excuse to immediately remove her from the schedule stating the message was not in accordance with the values of the company. First of all, we have seen this e-mail and we have not seen anything to warrant such action. Secondly, this was not a public statement and it was not sent through Stromma’s communication channels either. Moreover, the same manager did not even behave according to generally accepted standards of decency with his aforementioned behaviour. But whatever she has written or where, no laws or regulations justify a kind of instant dismissal here (which is what this comes down to). In addition, how did the team leader get the message that Daria sent? The rumoured camera surveillance is apparently not the only breach of privacy at Stromma. In short: this is a nonsense dismissal.

A transparent trick

To top it off, Stromma is now trying to hide behind new legislation, which is actually intended to give workers with flexible contracts more rights. Since the beginning of this year, if you have a zero hour contract you can cancel your contract with a 4-day period. But Daria had clearly stated both verbally and in writing that she still wanted to work in February. Yet Stromma is now trying to pretend that she had used that 4-day period. This is a transparent trick, and we will not be fooled.

As Daria had been working at Stromma for more than 3 months, she was entitled to be scheduled according to the average number of hours she had worked in previous months. And if that does not happen, then she is entitled to the money she would have earned as if she had been scheduled. Because Daria worked an average of five and a half days a week, this amounts to a substantial sum even with a minimum wage: more than 2000 euros. And then we are not even considering the commission that she and her colleagues have missed, the amount of which remains unclear.

Our Demands:

That’s why we demand with Daria:
– Payment of the salary due to Daria for February
– Clarity and the correct payment of the commission to Daria and her colleagues
– Respect for the employees of Stromma

If these demands are not met, we will be forced to take action.
