Garden City New York convicted cyber criminal and well known tickle-pervert sues Google for $5 million dollars over blog exposing his US Federal convict past.

HEADLINE: Garden City New York man sues Google, a Beverly Hills producer, and several other defendants in US District Court in the Eastern District of New York for $5 million dollars each over blog that exposes his criminal past, including his Federal conviction relating to the tying/tickling of a 17-year-old high school student.


BODY:

David D'Amato (famous Internet cyber terrorist and convicted federal criminal), of Garden City, New York has filed a $5 million dollar lawsuit against several notable people and companies, totaling $20 million dollars because of a blog authored by David Starr, a noted Beverly Hills producer, and the lead defendant in that lawsuit. The reason for the lawsuit? David Starr's blog ( http://www.ticklishguyscasting.net) exposes David D'Amato's criminal past as a federal convict, and publishes the actual court documents relating to his federal conviction. It is understandable why he would want that supressed, his 2001 federal conviction was directly related to a 17-year old boy who refused to remove his shirt, be tied down, tickled, and videotaped for eventual airing on the Internet. When the boy refused, he was harassed and threatened by David D'Amato.

At the time of his arrest by the Federal Bureau of Investigation, he was pretending to be a 23 year old college 'sexy co-ed' to lure young males to his ticklish web from his computer terminal located in his Garden City penthouse. In reality David D'Amato is a balding, middle aged man in his 40s. When he was arrested, he was working at a high school as a vice-principal and guidance counselor in West Hempstead, New York. He managed to keep his conviction a secret until school officials discharged him in 2001 after discovering his conviction after parents complained to the school regarding the tickling issue.

The $20 million dollar Federal Civil case is expected to address several issues regarding the First Amendment, and the public's right to access court records. In a hearing late May 2006 on this case, the judge refused to issue an order to cancel the blog's publication, and in her ruling she stated that to issue this order, "Would be repugnant to the First Amendment," and she cited several cases that support that statement.

This case could very well set the precident for the future of electronic publishing, along with other small magazines and newspapers nationwide. Either confirming them as legitimate news sources, thus granting them complete First Amendment protection, or if the case is lost - it would set the foundation for criminals everywhere, such as convicted child molesters and murderers, from having their past exposed for the knowledge and protection of the American public.

During an interview by a large East Coast magazine, David Starr was asked why he isn't just giving up and complying with David D'Amato's request to remove the blog, the response was very quick and strong in tone, "Back in the days of the Revoltionary War, many of our forefathers gave their lifes to protect the rights of Americans. The First Amendment is one of those rights and was written specifically because a king controlled the press. Now, I'll be damned if I let the First Amendment be trampled on by a guy who thinks he is king."
