Openbaar Ministerie: Bekendmaken dat De Vries en Verburg een vluchtelingengevangenis bouwt is 'smaad' - activisten moeten 23 mei voorkomen voor verspreiden posters

Utrecht, 10 april 2016 - Op dinsdagochtend 5 april werden omstreeks 02:00 uur in Stolwijk twee personen opgepakt op beschuldiging van het plakken van posters tegen de bouw van een nieuwe gezinsgevangenis voor vluchtelingen op Kamp Zeist door het lokale bouwbedrijf De Vries en Verburg. De twee activisten moeten nu wegens 'smaadschrift' voorkomen voor de politierechter in Den Haag, op 23 mei om 9 uur. De grote vraag is hoe het vertellen van de waarheid aangemerkt kan worden als 'smaad'. AAGU roept op om de posters te blijven verspreiden.

Volgens het OM randt de tekst op de posters ("Bouwbedrijf De Vries en Verburg - uw duurzame partner in deportaties - Bouwt vol trots de gezinsgevangenis voor vluchtelingen op Kamp Zeist") de "eer en/of de goede naam van Bouwbedrijf De Vries en Verburg B.V." aan.
Smaadschrift kan alleen vervolgd worden op aangifte van de betrokken partij, De Vries en Verburg dus. De Vries en Verburg bouwt echter wel degelijk een gezinsgevangenis voor vluchtelingen op Kamp Zeist, de zogenaamde 'Gesloten Gezinsvoorziening', waarin gezinnen en alleenstaande minderjarige vluchtelingen in afwachting van uitzetting worden vastgehouden.

De Anarchistische Anti-deportatie Groep Utrecht (AAGU) voert om deze reden al sinds afgelopen zomer campagne tegen De Vries en Verburg. De betreffende postertekst wordt vanaf het begin van de campagne gebruikt, en openlijk verspreid via posters, stickers, websites en sociale media. Nog geen twee weken geleden etaleerde een 'promotieteam' van AAGU de posters bij een stand van De Vries en Verburg op de bouwbeurs 'Building Holland' in de RAI. Activisten werden toen opgepakt wegens huisvredebreuk, de postertekst zelf bleef buiten schot. AAGU roept op de posters en stickers met de gewraakte tekst te blijven verspreiden.

Tijdens het verhoor na de arrestatie van afgelopen maandagnacht werd de arrestanten verteld dat de politie vindt dat de tekst op de posters 'negatieve uitlatingen' bevat over De Vries en Verburg. Een curieuze opvatting aangezien de postertekst feitelijk juist is. Of is het bedrijf inmiddels niet meer 'vol trots' over het bouwen van een gevangenis om vluchtelingengezinnen hun toekomst te ontnemen? Hoe dan ook, het is onbestaanbaar dat mensen vervolgd worden wegens het verspreiden van 'negatieve uitlatingen' over een bedrijf, zeker wanneer deze op feiten gebaseerd zijn.

Het is niet de eerste keer de laatste jaren dat er repressief opgetreden wordt tegen mensen of groepen die meningen verkondigen die staat of bedrijven onwelvallig zijn. Vorig jaar werd activiste Joke Kaviaar definitief tot twee maanden voorwaardelijke celstraf veroordeeld wegens een aantal kritische teksten over het migratiebeleid. Ook de massale arrestatie van anti-Zwarte Piet-activisten in Gouda (november 2014) of de aanvankelijke vervolging van Abulkassim Al-Jaberi voor het roepen van 'Fuck de koning' zijn voorbeelden van pogingen van justitie om geluiden die ingaan tegen de heersende rechtse tijdsgeest in de kiem te smoren.

De permanente gezinsgevangenis voor vluchtelingen wordt deze of volgende maand in gebruik genomen. Het opsluiten van kinderen, onder welke omstandigheden dan ook, veroorzaakt altijd grote schade bij hen, zo hebben diverse onderzoeken aangetoond.

AAGU zal zich in blijven zetten tegen de opsluiting van vluchtelingen, voor vrijheid van beweging en voor het afschaffen van staten en grenzen. Bedrijven die geld verdienen aan het tegenhouden, opsluiten en/of deporteren van vluchtelingen zullen daarbij aangesproken blijven worden op hun besmette werk.
Op zondag 29 mei, om 15.30 uur, vindt bij Kamp Zeist een lawaaidemonstratie tegen het opsluiten van kinderen plaats. Dit is de afsluiting van de tweede door 'Geen Kind aan de Kant' georganiseerde demotour langs gezinslocaties voor vluchtelingen. Veel in deze locaties verblijvende gezinnen komen, na ochtendlijke politierazzia's, in de gezinsgevangenis terecht in afwachting van hun deportatie.

Utrecht April 10 2016 - On Tuesday morning about 2 PM two people got arrested in Stolwijk on charges of pasting posters against the construction of a new family prison for refugees at Kamp Zeist by local construction company De Vries en Verburg. Now, the two activists have to stand trial because of a 'libel' suit at the magistrate in The Hague, May 23 at 9 am. The big question is how telling the truth can be regarded as 'libel'. AAGU calls to continue to spread the posters.

According to the Prosecution the text on the posters ("Construction company De Vries en Verburg - your durable partner in deportations - Proudly builds the family prison for refugees at Kamp Zeist"), defaces the "honor and/or reputation of Bouwbedrijf De Vries en Verburg BV ". Libal can only be prosecuted after the party concerned pressed charges. So that would be De Vries en Verburg. De Vries en Verburg, however, indeed builds a family prison for refugees at Kamp Zeist, the so-called "Closed Family Facility" in which families and unaccompanied minors are detained pending deportation.

Because of this, since last summer the Anarchist Anti-deportation Group Utrecht (AAGU) campaigns against De Vries en Verburg. The poster text in question is being used from the beginning of the campaign, and has been publicly spread through posters, stickers, websites and social media. Less than two weeks ago a 'promotion team' of AAGU showcased the posters at a stand of De Vries en Verburg at the construction fair "Building Holland" in the RAI. Activists were then arrested for trespassing, the poster text itself was not an issue. AAGU calls to continue to spread the posters and stickers with the text. During the interrogation after the arrest last Monday night the police told the detainees that the text on the posters contained 'negative statements' about De Vries en Verburg. A curious conception as the poster text is factually correct. Or is the company no longer "proudly" building a prison for refugee families to deprive them of their future?

Anyway, it's impossible that people are being prosecuted for spreading "negative statements" about a company, especially when they are based on facts.
It is not the first time in recent years that repressive action is taken against individuals or groups who proclaim opinions that the state does not like to hear. Last year, activist Joke Kaviaar was convicted to a two months suspended prison sentence because of a number of critical texts about migration policy. The mass detention of anti-Zwarte Piet (Black Pete) activists in Gouda (November 2014), or the initial prosecution of Abulkassim Al-Jaberi for yelling "Fuck the King" are examples of attempts by the Prosecution to kill ideas that go against the ruling right-wing zeitgeist in the bud.

The permanent family prison for refugees will either this month or the next be commissioned. The detention of children, under any circumstances, always causes great damage to them, several studies have found.

AAGU will remain taking efforts against the detention of refugees, for freedom of movement and the abolition of states and borders. Companies that make money from stopping, inprisoning and/or deporting refugees will still be held accountable for their dirty work. On Sunday, May 29th, at 15:30, there will be a noise demonstration at Kamp Zeist against the detention of children. This is the conclusion of the second demo tour along family locations for refugees organized by "Geen Kind Aan De Kant" ("No Child To The Side"). Many families in these locations end up in the family prison after dawn raids, awaiting their deportation.
