5 december: voortzetting rechtszaak tegen activisten wegens 'smaadschrift': bouwer gezinsgevangenis voor vluchtelingen De Vries en Verburg blijft de ogen sluiten voor medewerking aan deportaties.

Aanvang rechtzaak: 13.30 uur, rechtbank Den Haag, Prins Clauslaan 60. De activisten die moeten voorkomen zullen voorafgaand aan de zitting met de betreffende posters voor de rechtbank staan. Als je mee wilt doen, zorg dan dat je er om 12.30 uur bent.

Op dinsdagochtend 5 april werden in Stolwijk twee personen opgepakt op beschuldiging van het plakken van posters tegen de bouw van de nieuwe gezinsgevangenis voor vluchtelingen op Kamp Zeist door het lokale bouwbedrijf De Vries en Verburg. De twee activisten moeten wegens 'smaadschrift' voorkomen voor de politierechter in Den Haag, op 21 september om 13:50 uur. Een eerdere zitting werd uitgesteld om een door de activisten opgeroepen getuige, de aangever van De Vries en Verburg, door de rechter-commissaris te laten horen.

Deze getuige, dhr. V.E.M. Donk, directeur risk & compliance van Burgland Vastgoed B.V., het moederbedrijf van De Vries en Verburg, is inmiddels gehoord. Deze beklaagt zich vooral over het gebruik van het woord 'deportaties', een woord dat notabene door de marechaussee zelf wordt gebruikt als het om 'uitzettingen' gaat. Het gaat in deze zaak dus vooral over hoe de waarheid wordt benoemd. De overheid, en dus ook bedrijven, hanteert verhullend taalgebruik. Wij noemen de dingen liever bij de naam.

Volgens het OM randt de tekst op de posters (“Bouwbedrijf De Vries en Verburg - uw duurzame partner in deportaties - Bouwt vol trots de gezinsgevangenis voor vluchtelingen op Kamp Zeist”) de “eer en/of de goede naam van Bouwbedrijf De Vries en Verburg B.V.” aan. Maar De Vries en Verburg heeft wel degelijk een gezinsgevangenis voor vluchtelingen op Kamp Zeist gebouwd, de zogenaamde 'Gesloten Gezinsvoorziening', ook zo'n eufemisme, waarin gezinnen en alleenstaande minderjarige vluchtelingen in afwachting van hun deportatie worden vastgehouden.

De Anarchistische Anti-deportatie Groep Utrecht (AAGU) heeft sinds de zomer van 2015 campagne gevoerd tegen De Vries en Verburg. De betreffende postertekst is vanaf het begin van de campagne gebruikt. Wij van AAGU vinden het onbestaanbaar dat mensen vervolgd worden wegens het verspreiden van 'negatieve uitlatingen' over een bedrijf (aldus het proces verbaal), zeker wanneer deze op feiten gebaseerd zijn.

Het is niet de eerste keer de laatste jaren dat er repressief opgetreden wordt tegen mensen of groepen die meningen verkondigen die staat of bedrijven onwelvallig zijn. Vorig jaar werd activiste Joke Kaviaar definitief tot twee maanden voorwaardelijke celstraf veroordeeld wegens een aantal kritische teksten over het migratiebeleid. Ook de massale arrestatie van anti-Zwarte Piet-activisten in Gouda (november 2014) en Rotterdam (12 november jl), alsmede die van een demonstratie tegen repressie in Den Haag (19 november jl) zijn voorbeelden van pogingen van burgemeesters, politie en justitie om geluiden die ingaan tegen de heersende rechtse tijdsgeest in de kiem te smoren. De vervolging dit jaar wegens opruiïng voor een anarchistische muurkrant in Den Haag (OM direct in beroep na vrijspraak) en een 'Fuck de police'-poster in Brielle passen ook in deze trend.

De permanente gezinsgevangenis voor vluchtelingen is inmiddels in gebruik genomen. Het opsluiten van kinderen, onder welke omstandigheden dan ook, veroorzaakt altijd grote schade bij hen, zo hebben diverse onderzoeken aangetoond.
AAGU zal zich in blijven zetten tegen de opsluiting van vluchtelingen, voor vrijheid van beweging en voor het afschaffen van staten en grenzen. Bedrijven die geld verdienen aan het tegenhouden, opsluiten en/of deporteren van vluchtelingen zullen daarbij aangesproken blijven worden op hun besmette werk.

On Tuesday morning April 5 two persons were arrested in Stolwijk on charges of pasting posters against the construction of the new family prison for refugees at Kamp Zeist by local construction company De Vries and Verburg. The two activists now have to appear before the magistrate in The Hague because of 'libel' on September 21 at 1:50 pm. An earlier hearing was postponed to have a witness, who pressed the charges on behalf of De Vries en Verburg and who was called by the activists, heard by the examining magistrate.

This witness, mr. V.E.M. Donk, director of risk and compliance of Burgland Vastgoed BV, the parent company of De Vries en Verburg, has now been heard. He complains in particular about the use of the word 'deportation', a word which actually is used by the military police themselves when it comes to 'repratrions. So this case is mostly about how the truth is being denominated. The government, and hence companies, likes to cloud the issue. We rather call things by name.

According to the Public Prosecution the text on the posters assaults ( "Construction company De Vries en Verburg - your long-term partner in deportations – proudly builds the family prison for refugees at Kamp Zeist"), the "honor and / or reputation of Bouwbedrijf De Vries en Verburg BV ". But De Vries and Verburg has indeed built a family prison for refugees at Kamp Zeist, called "Closed Family Facility", also a euphemism, in which families and unaccompanied minors are detained pending their deportation.

Since the summer of 2015 the Anarchist Anti-deportation Group Utrecht (AAGU) has campaigned against De Vries en Verburg. The text of the poster has been used from the start of the campaign. We at AAGU find it unacceptable that people are being prosecuted for spreading "negative statements" about a company (according to the police report), especially when they are based on facts.

It is not the first time in recent years that repressive action is taken against individuals or groups who proclaim opinions that state or companies do not like. Last year, activist Joke Kaviaar was sentenced to a two months suspended prison sentence because of a number of critical texts about migration policy. The mass detention of anti-Zwarte Piet activists in Gouda (November 2014) and Rotterdam (last November 12), as well as at a demonstration against repression in The Hague (last November 19) are examples of attempts by mayors, police and prosecution to nip voices that go against the ruling right-wing zeitgeist in the bud. This years' prosecution on charges of incitement because of an anarchist wall paper in The Hague (prosecution appealed immediately after acquittal) and a 'Fuck de police'-poster in Brielle also fit in this trend.

By now, the permanent family prison for refugees has been put into use. The detention of children, under any circumstances, always causes great damage to them, several studies have found.
AAGU will remain in action against the detention of refugees, for freedom of movement and the abolition of states and borders. Companies that earn money from stopping, incarcerating and / or deporting refugees will thereby continue to be held accountable for their contaminated work.
