Vandaag was er bij de Raad van State in Den Haag een zitting over de toekomst van Huize Ivicke. De al drieënhalf jaar gekraakte villa te Wassenaar zou ontruimd moeten worden omdat het pand officieel een kantoorbestemming heeft. De bestuursrechter in Den Haag besloot op 20 december dat leegstand belangrijker is dan bewoning, en de bewoners zijn hiertegen in hoger beroep gegaan. Om te voorkomen dat ze vóór het hoger beroep al ontruimd zouden worden, hebben ze een zogenaamde voorlopige voorziening aangevraagd. Die aanvraag werd vandaag behandeld bij de Raad van State. De rechtszaak gaat tussen de bewoners van Ivicke en de gemeente Wassenaar, die bewoning in strijd met het bestemmingsplan wil beëindigen.

In de uitspraak van 20 december was de rechter nauwelijks ingegaan op de belangen van de bewoners. In het bestuursrecht was het lange tijd vrij gebruikelijk dat er weinig naar belangen (en alleen naar de juridische aspecten) wordt gekeken. Naar aanleiding van de toeslagenaffaire is de Raad van State afgelopen jaar echter tot de conclusie gekomen dat de concrete gevolgen van hun beslissingen toch ook best belangrijk zijn. Op basis hiervan beargumenteren de bewoners dat hun belang om niet op straat gezet te worden zwaarder moet worden meegewogen. De gemeente vindt natuurlijk dat de belangen van de bewoners in de uitspraak van 20 december wel voldoende zijn behandeld, en dat het belangrijker is om een abstract bestemmingsplan te handhaven en te ontruimen voor leegstand.

Dat brengt ons bij de derde procespartij: de eigenaar van Huize Ivicke. Die zegt namelijk van plan te zijn om in het pand zijn eigen kantoor te vestigen. De bestuursrechter vond dat genoeg reden om ervan uit te gaan dat Ivicke niet weer leeg zal komen te staan, maar de reputatie van de eigenaar geeft meer dan genoeg aanleiding om zijn plannen niet al te serieus te nemen. De eigenaar, Ronnie “Krottenkoning” van de Putte, die het pand heeft laten vervallen, nog nooit iets heeft ontwikkeld, wiens leegstaande panden regelmatig “zomaar” afbranden en ga zo maar door, is aan komen zetten met een paar tegenstrijdige A4'tjes. Bovendien heeft hij nergens een vergunning voor aangevraagd. Zijn advocaat zegt dat hij daar niet aan kan beginnen zolang het pand nog gekraakt is, maar dat is natuurlijk onzin. De bewoners beargumenteren dat ook naar de belangen van de eigenaar moet worden gekeken, en dat die in dit geval dus weinig voorstellen. Zelfs de gemeente had er duidelijk een hard hoofd in dat de eigenaar zijn woorden nu opeens wel in daden om zou zetten.

Uiteindelijk stelde de rechter vandaag aan gemeente en eigenaar de vraag waar de zitting om draaide: “Hoe dramatisch is het om te wachten met ontruimen tot het hoger beroep?” Beide partijen hadden daar weinig overtuigende antwoorden op. De gemeente vond dat het allemaal al veel te lang geduurt had inmiddels, en de advocaat van de eigenaar begon wat over mensen die uit recreatiewoningen gezet worden, waarna de rechter hem herinnerde dat dat niet was waar hij naar vroeg. Uiteindelijk gaf de advocaat toe dat dat alleen zou inhouden dat het bedrijf van de eigenaar wat financieel nadeel zou ondervinden. In een slotwoord van één van de bewoners kwam duidelijk naar voren dat zij wel ernstig en onherroepelijk nadeel ondervinden van handhaving vóór het hoger beroep. Dakloos worden in de huidige wooncrisis is niet niks.

Aan het eind van de zitting deelde de rechter mee dat hij uitspraak zal doen binnen twee weken, maar eerder als het kan. Dat brengt voor de bewoners twee weken aan onzekerheid met zich mee. Sommige dingen in de zitting stemmen hoopvol, maar andere minder: het kan alle kanten op gaan. We houden rekening met het ergste. Hou de komende twee weken de website in de gaten voor updates. Ivicke zal niet wijken voor leegstand en speculatie!

Today, there was a hearing at the Raad van State in The Hague, which will decide the future of Huize Ivicke. The villa in Wassenaar that has been squatted for three and a half years is threatened with eviction because the building is officially designated as an office. In a court case on December 20th, the administrative judge in The Hague decided that vacancy was more appropriate than occupation, to which the residents have filed an appeal. To prevent an eviction before the date of the higher appeal, they have applied for a so-called preliminary injunction. This request was heard today by the Raad van State. The lawsuit is between the residents of Ivicke and the municipality of Wassenaar, with the latter wanting an immediate end of the occupation in violation of the zoning plan.

During the ruling on December 20th, the judge hardly considered the interests of the residents. In administrative law it has long been customary that little attention is paid to interests and results of decisions, but rather to the legal aspects of a case. As a result of the “toeslagenaffaire,” however, the Raad van State realised last year that the concrete consequences of their decisions are also somewhat important. Based on this, the residents argue that their interest to not be thrown out into the street must weigh more heavily. On the other side, the municipality apparently found the interests of the residents sufficiently dealt with and considers the enforcement of an abstract zoning plan and eviction for vacancy to be more important.

Then there is the third party of the lawsuit: the owner of Huize Ivicke. They claim that they are planning to transform the house into an office space for their own company. The administrative judge considered this enough reason to assume that Ivicke will not be vacant once again. However, the reputation of the owner gives more than enough reason to think otherwise. For the hearing, the owner, Ronnie “Slum King” van de Putte, who has allowed the building to decay, has never developed anything, and whose vacant buildings regularly burn down “just like that” and so has come up with a few contradictory A4 pages to make his case. He did not apply for permits for any of his plans, either. As a reason, his lawyer claims that this is not possible while the house is still squatted, which of course is complete nonsense. The residents argue that the interests of the owner should also be considered, and that in this case they clearly do not amount to much. It was clear that even the municipality had a hard time believing that the owner would now suddenly start to put his money where his mouth is.

Finally, the judge asked the municipality and the owner the question that was at the core of the hearing: “How big of a deal would waiting with the eviction until the higher appeal be?” Both parties offered responses that were barely convincing: The municipality argued that the whole process had already been going on for too long and the lawyer of the owner started talking about people who get kicked out of their holiday homes before the judge reminded him that this had nothing to do with the question at hand. In the end, the lawyer admitted that the only disadvantage would be some financial loss for his client’s company. The final statement of one of the residents again made it clear that they would in fact be gravely and irreparably affected by an enforcement before the higher appeal. Becoming homeless is undoubtedly shit, after all.

At the end of the hearing, the judge declared that he would come with the verdict within two weeks, but earlier if possible. This means two weeks of insecurity for the residents of Ivicke. Some aspects of the hearing allow for a hopeful feeling, while others have more of a negative tint: It could go either way. We remain prepared for the worst. Keep an eye on the website for updates in the next two weeks. Ivicke will not make way for vacancy and speculation.
